Agreement
By using tips.cx you agree to these terms. If you don't agree, please don't use the site or the app. Tips.cx is operated by Patrick Gardner. "We" and "us" mean Tips.cx and its operator; you can contact us at hello@tips.cx.
The calculator
The tip pool calculator is free to use for personal and business purposes. It splits the amounts you enter according to the hours, weights and rounding you choose. You are responsible for the numbers you enter, for checking the results, and for deciding how tips are shared at your business.
The calculator, the app, the guides and other content are general information and tools. They are not legal, tax, payroll or accounting advice. Tip pooling rules vary by state, so check your state's labor department or an advisor before setting up or changing a tip pool.
The tip sheet template
You may print, copy and use the tip sheet and the CSV template for your own business, including sharing copies with your staff. Please don't resell them.
Early access
Joining the early-access list is free and doesn't commit you to buying anything. The features, plans and prices described on this site are what we intend to offer at launch. They may change before then, and the launch date isn't guaranteed.
Tips.cx accounts during the beta
Accounts are by invitation only during the beta and are free. The beta is a test period: features may change, and the service may occasionally be unavailable. Before any paid plan applies to your account, we will tell you by email, and nothing will be charged without your agreement.
- Your account. Keep your password and quick PIN private. You are responsible for what happens under your sign-in.
- Owners. The owner of an account is responsible for the managers they invite, for who knows each location's staff link and store PIN, and for changing them when staff leave.
- Staff links. Anyone with a staff link and its store PIN can log a shift and choose any name on that location's list. The name recorded is the one they chose; it is not a verified identity.
- Your records. The records you enter belong to your business. You are responsible for their accuracy, for telling your staff that their names, hours and payouts are recorded, and for how you use the records (for example, in paying tips or payroll). We use them only to provide the service to you. You can export them as CSV at any time.
- Closing an account. During the beta, the owner can ask us at hello@tips.cx to close the account and delete the business and all its records. We'll confirm before deleting anything. Deleted records also leave our backups within 14 days.
Keep your own copies of anything you need for your records, for example by exporting from History regularly. We work hard to keep records safe, but during the beta you shouldn't rely on Tips.cx as your only copy.
Acceptable use
Please don't:
- submit email addresses that aren't yours, or submit the sign-up form automatically;
- try to access an account, a business or a staff link that isn't yours, or guess passwords or PINs;
- try to break, overload or get around the security of the site or app;
- copy the site's design or content to present it as your own.
We may suspend or close an account that breaks these terms or puts other users at risk. Where we reasonably can, we'll tell you first and give you a chance to export your records.
Our content
The Tips.cx name, logo, website and app design and written content belong to Tips.cx. Apart from the tip sheet template described above, you may not reproduce them without our permission. Quoting short passages with a link back is fine.
No warranty
The site, the calculator and the app are provided "as is" and "as available". We work hard to make the calculations correct and the service reliable, but to the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent the law allows, Tips.cx is not liable for any indirect, incidental, special or consequential damages, or for lost profits, wages or data, arising from your use of the site, the calculator or the app. Our total liability for any claim relating to the free site or the free beta is limited to US$50. Some places don't allow these limits, so they may not apply to you.
Changes and ending use
We may update these terms; the date at the top shows the latest version, and continuing to use the site or app means you accept the update. If a change significantly affects account holders, we'll tell them by email before it takes effect. We may change or discontinue any part of the free site or the beta; if we discontinue the beta, we'll give account holders notice and time to export their records.
Governing law
These terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law rules. If any part of these terms is found unenforceable, the rest stays in effect.
